These Terms of Service ("Terms") govern your use of the Agility Writer platform and services available at agilitywriter.ai ("Service"), operated by Agility Writer ("we," "us," or "our"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Account Registration
To use the Service, you must create an account by providing accurate, complete information. You are responsible for maintaining the security of your account credentials and for all activities that occur under your account. You must notify us immediately if you suspect unauthorized access to your account.
You must be at least 18 years old to create an account and use the Service. By registering, you represent that you meet this age requirement.
2. Service Description
Agility Writer is an AI-powered content generation platform that produces SEO-optimized articles based on keyword inputs and live search engine results data. The Service includes content generation in various modes (1-Click, Advanced, Bulk), content optimization tools, topical map generation, and publishing integrations.
The Service uses artificial intelligence to generate content. While we strive for accuracy and quality, AI-generated content may contain errors, inaccuracies, or require editing. You are responsible for reviewing, verifying, and editing all generated content before publishing. We do not guarantee that generated content will achieve specific search rankings or traffic results.
3. Credits and Payment
3.1 Credit System
The Service operates on a credit-based system. Each article generation consumes one credit. Credits are available through one-time purchases (Pay-As-You-Go) or subscription plans. Trial accounts receive a limited number of credits as specified at the time of registration.
3.2 Pricing and Billing
Current pricing is displayed on our pricing page. We reserve the right to change pricing at any time with 30 days notice to existing subscribers. Price changes do not affect credits already purchased.
Pay-As-You-Go credits do not expire and remain in your account until used. Subscription credits are available as long as your subscription is active and are forfeited upon cancellation.
3.3 Subscriptions
Subscription plans are billed monthly. Your subscription automatically renews each billing period unless you cancel before the renewal date. You can cancel your subscription at any time through your account settings or the Stripe Customer Portal. Cancellation takes effect at the end of the current billing period.
3.4 Refunds
Pay-As-You-Go credit purchases are non-refundable once credits have been used. Unused credits from Pay-As-You-Go purchases may be eligible for a refund within 14 days of purchase. 4. Content Ownership and Usage
4.1 Your Content
You retain ownership of all content inputs you provide (keywords, fact sheets, outlines, and custom instructions) and all content generated through the Service using your account. You are free to use, publish, modify, and distribute generated content for any lawful purpose without attribution to Agility Writer.
4.2 No Exclusivity
The Service may generate similar content for different users who enter similar keywords or topics. We do not guarantee that generated content is unique across all users. You are responsible for checking content originality before publishing if uniqueness is required.
4.3 Content Responsibility
You are solely responsible for all content you publish that was generated through the Service. This includes ensuring factual accuracy, compliance with applicable laws, and adherence to any platform guidelines where you publish the content. We are not liable for claims arising from your use or publication of generated content.
5. Acceptable Use
You agree not to use the Service to:
- Generate content that is illegal, defamatory, threatening, or promotes violence or discrimination
- Produce content designed to deceive or defraud (including phishing content, fake reviews, or misinformation)
- Create content that infringes on the intellectual property rights of others
- Generate spam or mass-produce low-quality content intended solely to manipulate search rankings
- Attempt to reverse-engineer, copy, or extract our proprietary algorithms, prompts, or systems
- Share, resell, or redistribute your account access or credits to third parties
- Overload or disrupt the Service through automated scripts, bots, or excessive API usage beyond your plan limits
We reserve the right to suspend or terminate accounts that violate these usage policies without refund.
6. Intellectual Property
The Service, including its design, features, algorithms, prompts, documentation, and branding, is owned by Agility Writer and protected by intellectual property laws. These Terms do not grant you any rights to our intellectual property except the limited right to use the Service as described herein.
7. Third-Party Services
The Service integrates with third-party platforms including WordPress, Zapier, Stripe, Google Search Console, and AI model providers. Your use of these integrations is subject to the respective third-party terms and privacy policies. We are not responsible for the availability, security, or performance of third-party services.
8. Service Availability
We strive to maintain the Service available 24/7 but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We will make reasonable efforts to provide advance notice of planned downtime.
We reserve the right to modify, suspend, or discontinue any feature of the Service at any time. If we discontinue the Service entirely, we will provide at least 30 days notice and refund any unused Pay-As-You-Go credits.
9. Limitation of Liability
To the maximum extent permitted by law, Agility Writer and its officers, directors, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or revenue, arising from your use of or inability to use the Service.
Our total liability for any claim arising from or related to the Service shall not exceed the amount you paid to us in the 12 months preceding the claim.
10. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We disclaim all warranties including, but not limited to, merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that generated content will be error-free, unique, or achieve specific search engine rankings.
11. Indemnification
You agree to indemnify and hold harmless Agility Writer from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service, your published content, or your violation of these Terms.
12. Governing Law
These Terms are governed by the laws of Malaysia. Any disputes arising from these Terms or the Service shall be resolved through binding arbitration in Kuala Lumpur, Malaysia, except where prohibited by local law.
13. Changes to Terms
We may update these Terms from time to time. When we make material changes, we will notify you by email or by posting a notice on the Service. Continued use of the Service after the effective date of changes constitutes acceptance of the updated Terms. If you do not agree with the changes, you must stop using the Service and close your account.
14. Termination
You may terminate your account at any time by contacting support@agilitywriter.ai or through your account settings. We may terminate or suspend your account if you violate these Terms, fail to pay outstanding fees, or for any reason with 30 days notice.
Upon termination, your right to use the Service ceases immediately. We will retain your data for 30 days after termination, after which it will be permanently deleted unless retention is required by law.
